Statements and Limitations

Budney Overhaul & Repair, Ltd. (Seller) warrants to Buyer that at the time of delivery, the goods sold will be free from defects in material, manufacture and repair as required by the scope of the work performed in accordance with the contract and specifications specified therein. Seller's liability and Buyer's remedy under this warranty are limited to (at the Seller's option) the repair, replacement or credit of the price paid for work performed. The above is premised on written notice of the defect having been given by Buyer to Seller within one year after the date of delivery of such goods by Seller. Transportation charges for the return of defective goods to Seller and their reshipment to Buyer, if applicable, and risk of loss thereof will be borne by Seller only if returned in accordance with written shipping instructions from Seller.

The proceeding warranty is in lieu of all other expressed or implied warranties and the remedies are in lieu of all other remedies. The express warranty set forth excludes all implied warranties including the warranty of fitness and suitability for a particular or intended purpose. Budney Overhaul & Repair, Ltd. shall not be liable for prospective profits or special, indirect, or consequential damages, nor shall recovery of any kind against Budney Overhaul & Repair, Ltd. be greater in amount than the purchase price charged by Budney Overhaul & Repair, Ltd. for work performed as per the purchase order.
